Article 1. Definitions
1.1 Platform (Daddy’s Jet): the electronic environment provided at daddysjet.com where listings of licensed air carriers are published and users can send non-binding requests to those carriers.
1.2 Platform Provider: the company that runs the Platform. Its legal name, address, MERSIS number, contact details and Electronic Commerce Information System (ETBIS) registration details will be published on this page and on the Platform’s Contact page once the legal review is complete.
1.3 Operator: an air carrier that holds a valid commercial air transport operating licence issued by the competent civil aviation authority of Türkiye or of its own country, has signed an intermediation agreement with the Platform Provider and whose licence has been verified by the Platform Provider.
1.4 User: any natural or legal person using the Platform.
1.5 Listing: an advertisement published on the Platform by an Operator for a specific flight, on conditions and at a price set by the Operator.
1.6 Request: a non-binding notice that a User sends through the Platform to one or more Operators for a Listing or for a flight need not covered by a Listing.
1.7 Offer: an Operator’s reply to a Request, on its own conditions and at its own price.
1.8 Confirmation: the Operator’s written notice to the User that it accepts a Request.
1.9 Contract of Carriage: the air carriage contract made after Confirmation between the User and the Operator, on the Operator’s conditions.
Article 2. Nature of the Platform
2.1 The Platform is a listing and request platform operated as an intermediary service provider under Turkish Law No. 6563 on the Regulation of Electronic Commerce. The Platform Provider brings Operators together with potential customers; it publishes Operators’ listings and passes Users’ Requests to Operators.
2.2 The Platform Provider:
- a) does not sell flights or issue tickets;
- b) does not make reservations or hold seats or aircraft in the name or on behalf of an Operator;
- c) does not make a Contract of Carriage on behalf of an Operator or make any statement binding on an Operator;
- d) does not take any payment from the User, whether as a flight price, advance payment, deposit or under any other name, and does not hold funds in escrow;
- e) does not set or change the flight price and adds no charge to it;
- f) does not create tours or package tours, does not arrange or sell any product combining transport with accommodation or other tourism services, and does not organise transfer services;
- g) does not operate aircraft and is not a carrier.
2.3 The Platform Provider is not a party to the Contract of Carriage. The seller and provider of the carriage service and the party to the Contract of Carriage is always the Operator.
Article 3. Listings, offers and price
3.1 Every Listing and Offer belongs to the Operator. The date, time, aircraft type, capacity, conditions and price of the flight are set by the Operator.
3.2 The price shown on the Platform is the Operator’s selling price. The Platform Provider does not change this price and adds no charge of any kind to it.
3.3 The price is for the whole aircraft, not per seat. The currency is stated in the Listing or Offer. What the price covers (for example, whether airport and service charges are included) is set out in the Operator’s conditions.
3.4 Price and availability in Listings and Offers are subject to the Operator’s Confirmation.
3.5 Any discount or previous price shown in a Listing is based on the Operator’s statement. The Operator is responsible for that display complying with commercial advertising law.
3.6 The Platform Provider verifies each Operator’s licence before admitting it to the Platform and throughout the agreement. Listings of an Operator whose licence ceases to be valid are removed.
Article 4. Neutral comparison and the seller’s identity
4.1 So that Users can compare Listings and Offers neutrally by price, aircraft, capacity and service conditions rather than by brand or company name, and so that all Operators are assessed on equal terms, Operators are shown at the comparison stage with the code assigned to them and their licence verification status. Every Listing and Offer clearly states that the seller is a licensed Operator.
4.2 When an Operator confirms a Request, the User is informed in writing of the Operator’s legal name, address, country, operating licence and contact details before making any payment and before the Contract of Carriage is made. The User decides whether to make the Contract of Carriage after seeing this information.
Article 5. Request process
5.1 A Request is not binding. Sending a Request does not hold the flight for the User; other Users may send Requests for the same Listing.
5.2 The process runs as follows:
- a) The User fills in and sends the Request form personally; no payment is taken at this stage.
- b) The Platform forwards the Request automatically to the relevant Operator. A Request for a flight not covered by a Listing is forwarded on the same terms to Operators whose fleet suits the Request.
- c) Operators decide for themselves whether to make an Offer or confirm the Request. The Platform Provider does not make Offers, set prices or negotiate on behalf of an Operator.
- d) On Confirmation, the User is informed of the details listed in Article 4.2.
- e) The Operator sends the User the conditions of the Contract of Carriage, the payment terms and the payment link in its own name and through its own payment channel.
- f) The User makes the Contract of Carriage with the Operator and pays the Operator directly. The Operator issues the invoice.
5.3 A flight is held for the User only by the Operator’s Confirmation and a Contract of Carriage made on the Operator’s conditions. Holding, finalising and ticketing the flight are the Operator’s own acts, not the Platform Provider’s, and take place in the Operator’s systems.
Article 6. Fees and payment
6.1 The User pays the Platform Provider no fee, commission, service charge or any other payment under any name. Use of the Platform is free of charge for the User.
6.2 The full flight price is paid directly to the Operator. The Platform Provider does not collect payments, does not act as an intermediary for payments and does not take card or bank details from the User. The User is never asked to pay money into the Platform Provider’s account; a User who receives such a request should report it to the Platform Provider.
6.3 The Platform Provider’s income consists solely of fees invoiced to Operators under its intermediation agreements with them, in return for the listing, request forwarding and software services it provides to Operators. These fees are not charged to the User.
Article 7. Contract of carriage, cancellation and refunds
7.1 The conditions of the Contract of Carriage and the cancellation, change and refund rules are set by the Operator and communicated to the User with the Confirmation. The User is advised to read these conditions before paying.
7.2 Because the Operator receives the payment, the Operator also makes any refund. The Platform Provider holds no money and therefore cannot make refunds; the User may send a refund request to the Operator through the Platform’s communication tool.
| Situation | Outcome |
|---|---|
| The Operator did not confirm the Request | No charge arises. |
| The User withdrew before paying | No charge arises. |
| The flight could not take place due to force majeure (such as weather, technical failure or airspace closure) | The Operator makes the refund in line with its conditions and applicable law. |
| The User cancelled after paying or did not show up for the flight | The Operator’s cancellation conditions apply. |
7.3 The performance and safety of the flight and its compliance with aviation law are the Operator’s responsibility.
Article 8. The Platform’s communication tools
8.1 The Platform provides a communication tool for correspondence between the User and the Operator. Offers, Confirmations, conditions and payment details sent by the Operator through this tool are the Operator’s own statements.
8.2 The Platform Provider’s team may give general information about how the Platform works, the information in Listings and the Request process. The team does not make Offers on behalf of an Operator, set prices or conditions, hold flights or take payments.
8.3 Correspondence through the Platform Provider’s social media accounts and other communication channels is also covered by this article. Requests are not accepted through these channels; the User is directed to the relevant Listing and to the Request form on the Platform.
Article 9. Passenger information and travel documents
9.1 Passenger details that the User gives the Operator in the Request or after Confirmation must match the identity document. Entering passenger details in the flight manifest is the Operator’s obligation.
9.2 Obtaining a valid ID or passport and checking visa and entry requirements are the passenger’s responsibility. If boarding is refused because of missing or incorrect documents, the Operator’s conditions apply.
Article 10. Personal data
10.1 The Platform Provider is the data controller for personal data processed for the use of the Platform and the forwarding of Requests. Details are set out in the privacy notice on the Platform.
10.2 For personal data passed to the Operator with a Request, the Operator is a separate data controller with regard to its own processing for the performance of the carriage service.
Article 11. Liability
11.1 The Contract of Carriage is made between the User and the Operator. The Operator is liable for the performance and safety of the flight, for any damage arising during carriage and for refunding the price paid; this liability is determined under the applicable aviation law and international conventions.
11.2 The Platform Provider’s liability is limited to publishing Listings, forwarding Requests, running the communication tool and verifying Operators’ licences. Liability for intent and gross negligence and the User’s rights under consumer law are reserved.
Article 12. Use of accounts
12.1 The User is responsible for keeping account details confidential; may not send Requests with false information; and may not use the Platform for unlawful purposes or interfere with its operation.
12.2 If these terms are breached, the Platform Provider may suspend the account.
Article 13. Intellectual property
13.1 The design, software, brand and texts of the Platform belong to the Platform Provider. Rights in photos and content supplied by Operators for their Listings belong to their owners; some aircraft photos are Creative Commons photos credited with their licences on the Photo credits page. They may not be used or reproduced without permission.
Article 14. Disputes
14.1 These terms are governed by the law of the Republic of Türkiye. The User’s right as a consumer to apply to consumer arbitration committees and consumer courts is reserved.
14.2 Complaints about the Platform can be sent to concierge@daddysjet.com. The Operator is the addressee of complaints about the carriage service; the Platform Provider passes such complaints on to the Operator.
Article 15. Changes
15.1 The Platform Provider may update these terms. The current text is published on the Platform and its date changes. A Request that has been sent is governed by the terms in force at the time it was sent; changes do not apply retroactively.
